The Terry Schiavo case in Florida has raised national awareness to the issues of life sustaining medical treatment.
A Health Care Proxy is a legal document in New York State which allows you to appoint someone to make health care decisions on your behalf if you lose the ability to make decisions for yourself.
The Koldin Law Center recommends to its clients that a Health Care Proxy be signed which also makes specific reference to one’s wishes regarding feeding tubes and hydration. Also, we suggest that a specific provision be in the Health Care Proxy expressly granting the appointed agent(s) authority to obtain your medical records under the HIPAA privacy laws.
The standard Health Care Proxy forms do not include specific instructions regarding feeding tubes, hydration and HIPAA. The Koldin Law Center is available to properly design your Health Care Proxy to include these important instructions.
